Adam B. Ziegler
Adam B. Ziegler is a partner in the firm. He specializes in business litigation, white collar defense, and SEC enforcement.
Business Litigation
Adam helps businesses protect their legal rights and economic interests in court. He represents companies in the technology, financial services, manufacturing, and media sectors in litigation involving complex contractual and fiduciary relationships, intellectual property rights, business torts and unfair competition.
Recent business litigation engagements include:
- Won a complete defense verdict for a public technology company client following a two-week federal jury trial concerning a buyer’s post-acquisition obligation to use “reasonable efforts” to develop and promote the acquired technology.
- Won dismissal of declaratory judgment claims challenging the validity of over 50 patents held by a public biotech company client.
- Won dismissal of defamation claims asserted by a computer software company against prominent documentary film producer based on the content of the client’s website. Subsequently won summary judgment dismissal of trademark claims arising out of client’s use of metatags within its website.
- Won partial dismissal of claims asserted against a large health plan based on its participation in a physician tiering program.
- Briefed and argued appeal before the U.S. Court of Appeals for the First Circuit on behalf of a public wireless paging company.
White Collar Defense and SEC Enforcement
Adam helps individuals and businesses minimize the risk and adverse effects of government enforcement action. In recent years, he has counseled and defended clients in connection with investigations conducted by the Department of Justice, SEC, FDA, FDIC, Massachusetts Attorney General’s Office, and Massachusetts Securities Division.
- Securities and Banking. Adam has represented clients in matters involving insider trading, mutual fund market timing, stock options, revenue recognition, derivatives accounting, public disclosures regarding exposure to mortgage-backed securities, ponzi schemes, investment suitability, and bank lending practices.
- Healthcare, Pharmaceuticals, and Medical Devices. Adam has represented clients in matters involving drug sales and marketing practices, drug manufacturing practices, product recalls, medical device malfunctions, and Medicare billing practices.
- Public Corruption and Government Contracts. Adam has represented individuals in matters involving political contributions, alleged bribery of public officials, and alleged fraud in the performance of government contracts.
Experience Prior to DCG
Prior to joining DCG, Adam worked as an associate in the litigation and white collar defense practice areas at Covington & Burling in Washington, DC and Goodwin Procter LLP in Boston. He also served as a law clerk to Judge James L. Ryan, U.S. Court of Appeals for the Sixth Circuit, and as an intern with the Appellate Staff, Civil Division, U.S. Department of Justice.
Education
Adam holds a B.A. in English from Davidson College and a J.D., magna cum laude, from the University of Michigan Law School, where he was elected Order of the Coif and served as Note Editor of the Michigan Law Review.
Admissions and Memberships
Adam is admitted to practice in Massachusetts and the District of Columbia, and he has appeared pro hac vice in state or federal courts in Colorado, Indiana, Maryland, Minnesota, and New York.
Adam is a member of the American Bar Association and Boston Bar Association.
